Did you know that the state of Georgia does not recognize abandonment as a divorce ground!
Many people that would like to separate from their spouse fear that leaving the house would be considered abandonment.
Many people confuse legal separation with just being separated and living in a bonafied state of separation.
There are many reasons that people stay in the marital home until there is a temporary hearing or final divorce decree. There are many reasons why it makes sense to leave the marital home so that you can avoid a simple battery charge, a domestic violence charge or temporary protective order.
You don't need to stay in the marital home. You can move out. Just make sure that you discuss how the bills will be paid when you move out. You need to work out a suitable interim arrangement so all bills are paid even after you move out. And to protect yourself, consider taking photos or a video of all of the marital property before you move out.
