In gestational surrogacy, a surrogate rents her womb to an infertile couple or gay couple or single parents. Sperm from the male partner in the couple is taken and female partner donates her egg. They are fertilized outside body and once an embryo is formed, it is transferred to the surrogate's womb. The surrogate carrying the pregnancy to term is known as the gestational surrogate mother. She is genetically unrelated to the child whereas the parents are genetically related. Gestational surrogacy is legal and offered at an affordable price at quality surrogacy agencies in India. In normal or traditional surrogacy, the sperm from the male is fertilized with the surrogate's egg. Female in the couple does not donate egg and is genetically unrelated to the child. The surrogate mother carries pregnancy to term and is genetically connected to the child. As per ICMR guidelines and Indian law, this type of surrogacy in India is not allowed. In natural surrogacy, because the surrogate mother is genetically related to the child, can claim her child if required whereas in gestational surrogacy, no such claim from her side stands in the court of law in India.
