In the past, USCIS has provided limited guidance concerning how USCIS officers review a sponsoring employer's Ability to Pay. In its latest policy update and for the general benefit of immigration petitioners, USCIS has formalized some longstanding informal practices while providing clarity on other longstanding, yet vague regulatory or policy language related to acceptable "financial" documentation, USCIS' arithmetic when reviewing ability to pay, all while opening up other documentary avenues to demonstrate ability to pay under a "totality of the circumstances" approach.
