The high-decibel political drama in Maharashtra is coming to an end, with Eknath Shinde taking oath as the new chief minister of the state on Thursday evening. While it is clear who is in power in Maharashtra, the question remains: Who is the real Shiv Sena?
Both Eknath Shinde and former CM Uddhav Thackeray have called their respective factions the real Shiv Sena. Both are asserting that they will carry forward the legacy of party founder Balasaheb Thackeray.
To begin with, it is important to note that parties need to approach the Election Commission for allotment of symbol or to stake claim on an existing one. In case of the latter, the commission takes a decision based on the support of party lawmakers and office-bearers for each faction.
In Shiv Sena's case, the new faction (Shinde camp) will not be recognised as a separate party immediately. The anti-defection law protects the rebel legislators as long as they merge with another party or form a new party.
Once parties approach the commission, then EC takes decision based on the Election Symbols (Reservation and Allotment) Order, 1968.
