The ruling was made in the U.S. District Court for the Western District of Texas. The decision resulted in dropped charges for one El Paso resident, Paola Connelly. In 2021, she was convicted of possessing and transferring a firearm as an admitted cannabis consumer.
The news reignited a conversation sparked by a similar ruling in February 2023. In that case, a federal judge in Oklahoma also ruled that the federal firearms ban for marijuana users was unconstitutional. That decision was appealed by a district court and will be heard by the U.S. Court of Appeals for the Tenth Circuit.
The federal laws governing firearm ownership and medical marijuana stretch back decades. The Gun Control Act of 1968 prohibits individuals from possessing guns or ammunition if they are addicted to or use any controlled substance.
