If you are injured on the job in Illinois, you are covered under Illinois Workers Compensation Act. Unlike other types of personal injury lawsuits, where you need to prove fault in order to recover compensation, Illinois workers comp law is not a fault-based system. In other words, you do not need to establish that your employer did anything negligent in order to recover compensation for your injuries.
Under the Illinois Workers Compensation Act, an injured worker is entitled to
recover three main benefits.
1. Lost Wages. When you are unable to work due to your injuries, you are entitled to receive two-thirds of your average weekly wage. These lost wage payments are tax-free.
2. Medical Benefits. The law states that your employer is responsible for paying medical expenses causally related to your injury. This includes past and future care including surgeries and rehabilitation.
3. Lump-Sum Award. When you have reached the maximum medical improvement level from your injury, you are entitled to a lump sum award. The lump payment is based on the type of injury you sustained and how much money you were making at the time.
