Let's say that you are visiting a friend or family member that is in one of the various jails in San Diego County, either at the Vista Jail, Central Jail, Los Colinas Jail, George Bailey Detention Facility, East Mesa Detention Facility, or maybe Facility Eight. If you go into the jail with a controlled substance that you had on you or drug paraphernalia, and you knew of its presence, you could be arrested for an alleged violation of Penal Code 4573.6. There are some defenses. For example, you didn't know it was on you. Another defense is that you had a prescription for the controlled substance. If convicted, one can be sentenced to two, three or four years in local, not state prison. Not a good day if going to see a friend in jail and then end up in the cell next to him or her.
