- We're with John Kelly. John is a personal injury attorney in Phoenix, Arizona, and he's agreed to answer some online questions. This question was, ah, so what that says, let me ask you the question, it was from Brian, Brian said, our daughter was killed in a car accident just outside of Phoenix, she was hit by a trucker. Navigating the legal process has been a complete nightmare, but we need to see it through for her sake. We're not really sure where to start. How can we, as her family, file a wrongful death suit before too much time passes?
- Well, you know, these cases are devastating, and Brian's daughter and the family's loss is something that, you know, it's something that no one really wants to talk to an attorney, you know. I sympathize with the family and their loss in this situation. It is important for people to talk to an attorney about a wrongful death claim, though. You know, there's a lot that's going on surrounding the circumstance, but sometimes an investigation is needed to be able to make a successful claim, and so when Brian, what I do with my families that are going through this, I have the whole family come in and sit down at a conference table, anyone that could be involved that wants to make a claim and I sit down with them and I talk over what their options are, and, you know, we go over what happens, and unfortunately we have to get into some of the details but I'm very conscious of making sure that everyone is comfortable in that situation and understands that they're just there to make sure that they're taking care of, you know, the lost person's interest, that they would want that, so what we need to do a lot of times in these kinds of cases is we need to actually get an investigator involved. Sometimes I bring in a couple of investigators to actually go out to the scene to get photographs, to talk to police officers, get reports, talk to other witnesses that we may have, and really establish the liability that we think we might have in the case, and it's a good idea to do that early, and Brian's right, you know, he wants to make sure he makes a claim before his time totals, or runs out. You know, typically in Arizona you'll have two years from the date of the decease, so that's something that has to be a concern because there's a lot to do, not a lot of time before you have to file a lawsuit because a lot of times we can actually settle these claims before filing a lawsuit, which is something that's a really good thing, and to do that and get a good result for the family is well worth it.
