The court of appeal has nullified the election of Embakasi South member of parliament Julius Mawathe. The appellate court quashed Mawathe’s August 2017 election win following a successful appeal lodged by former area MP Irshad Sumra of the Orange Democratic Movement. In his petition, Sumra cited several poll malpractices and irregularities, which he argued had an effect on the results announced. Through his lawyers, Sumra managed to convince the judge that the results announced by the IEBC officials were incorrect and that the elections were not free and fair. IEBC had declared that Mawathe had won the August poll after garnering 33,880 against Sumra’s 33,708 votes.
