President Joe Biden ordered federal labor officials on Friday to clarify when unemployed workers can refuse a job offer and continue to collect jobless benefits.
A work refusal generally shuts off jobless benefits for recipients but there’s been confusion as to how rules apply and when Americans can reasonably refuse a job offer.
That may apply to safety concerns like mask-wearing, social distancing and disinfecting surfaces at stores, manufacturing plants, and offices, for example.
According to an executive order, Biden asked the U.S. Labor Department to “consider clarifying that workers who refuse unsafe working conditions can still receive unemployment insurance.”
The order also states, “doing so will help ensure unemployed Americans don’t have to choose between paying bills and keeping their families safe.”
Worker advocates stated that this directive will be most impactful for frontline workers and communities of color.
The order meshes with another issued Thursday around healthy and worker safety, directing the U.S. Labor Department to issue revised guidance to employers within two weeks.
Up next, Colorado plans to start rolling out benefits in phases for people eligible for some federal unemployment benefits starting “late next week.”
The department’s Executive Director Cher Haavind said, “the federal benefits would come out in phases, starting with the FPUC benefit.”
Haavind said the FPUC benefits would be backdated to Dec. 27th and no action on a claimant’s behalf would be required.
People who were claimants on the PUA program as well as those on the PEUC program who had not exhausted their benefits when the CARES Act expired on Dec. 26th will be in the first phase of the federal benefits rollout.
The department will be emailing those eligible claimants next week about the steps they will need to take to receive benefits for the weeks since Dec. 26th.
And finally, the Pennsylvania Department of Labor and Industry says unemployment benefits will resume for residents making claims under the Pandemic Unemployment Assistance Program.
The PUA payments had been delayed for weeks as the department worked to update their computer system to meet new federal requirements.
It’s estimated that about 400,000 Pennsylvanians are relying on the PUA benefits.
Acting Secretary Jennifer Berrier said, “We know that more than 400,000 PennsylvaniansPennsylavnians and their families are relying on these benefits to get by and have worked as quickly as possible to complete the implementation and resume payments.”
