Slam the Gavel welcomes William Estrada, Esq. to the podcast. Attorney Estrada is a follower of Christ, husband, dad, nonprofit president, attorney, farmer, outdoorsman, retired Water Club Coordinator. Working as an attorney at the Home School Legal Defense Association and was there for 14 years and one of the works HSLDA does is representing families at the initial time of contact with CPS.
Parents are terrified when a Social Worker is at the door. Attorney Estrada says the there is a feeling of terror every family has when a Social Worker is at the door. The fear is universal as they understand that the child welfare system is broken and often times a parent is considered guilty until proven innocent and CPS are agents of the government who have the ability to remove a child from the home. They were able to help many parents.
Attorney Estrada also worked at U.S. Department of Health and Human Services and the Office for Civil Rights. At that time the office for Civil Rights was enforcing civil rights laws which were violating particularly minority family's rights. There were disproportional removals of minority children from minority families in numerous states and so there were enforcement actions the office for Civil Rights was handling.
In November of 2021, Attorney Estrada came on as the first full-time President to the Parental Rights Foundation related 501 (c)(3) nonprofit. It is a nationwide organization at the federal, state and local level and their focus is suing Social Workers who have violated families Due Process Constitutional rights. We discussed the case Doe v. Woodard, No. 18-1066 (10th Cir. 2019) and the outcome of that.
