Elder law attorneys focus on a number of areas of law that are of particular concern to senior citizens. Elder law includes Medicaid planning, which is legally and ethically protecting assets and getting the government to pay for some or all of long-term care. It refers to estate planning and that’s commonly the will, irrevocable trust. It refers to incapacity planning as well as your living will, your durable power of attorney, your healthcare surrogate designation – planning for what happens if the senior citizen becomes incapacitated. The will of course is planning for what happens after the senior citizen passes away. It also refers to areas of law commonly known as probate and guardianship as well as special needs planning.
