Awesome. So the last time you were here, we talked about the unimpeachable regular report and this comes in as a rebuttal report. And we're talking specifically about that, a lot of the same things, but some nuances and what we have to deal with. So I think if we start with some of the basics, so can we start to just describe, like, what is a rebuttal report? Like we know what it is, but what is a rebuttal report specifically when you have a valuation expert or another testifying expert in a litigation setting?
C. Zachary Meyers (00:01:15):
That's a good distinguishing characteristic because today I'm going to be talking about expert witness work in general, you know, about half of my practice is you know, personal injury, commercial damages, things like that. And the other half's consists of evaluation in some way, shape or form. And that's also litigation rebuttal generally speaking, you know, whenever you're in court, you have sometimes two different experts hired by either side on the case. And so depending upon maybe who puts out a report, first is common that the opposing counsel or opposing side will hire their own expert to rebut your work, or you will be hired to rebut someone else's work. And those expert reports, if put on the record generally, and you have to deal with a number of nuances with that when you're talking about either someone else's report or having to deal with what they're saying about your report, which can really, you know, the first time you read an expert report written by someone else about your expert report is shocking.
C. Zachary Meyers (00:02:19):
I think in the article, I write that I'm clutching my pearls because literally some of the stuff that you'll hear from opposing experts, it's not neutral. It's not unimpeachable. It's literally just throwing everything in the kitchen sink at you.
