in covid-19 outbreak every tenant and landlord have their own opinion for the rent. tenant wants some kind of relaxation on rent due to covid-19 and want to take a advantage of force majeure. so today we will discuss where this force majeure is applicable on rent agreement.
if in rent agreement force majeure is given and along with force majeure some clause also mention about this kind of situation that lessee can take advantage and can ask for waiver of rent or suspension of rent from the landlord than tenant/lessee can invoke this term.
if force majeure clause is not available and tenant wants to continue with the premises than he has the pay the rent to the landlord.
some of the tenant approaches supreme court on this issue and argue on impossibility of performance under doctrine of frustration under section 56 of indian contract act but supreme court held that lessee agreement not cover under section 56 of Indian Contract act as the lessee agreement is executed contract and this section only applies on executory contracts
if someone not having any agreement or above said clause are not available than Transfer of Property Act govern. Section 108 B(e) of TPA talks about force majeure but recently delhi high court held that covid 19 is cover under this section as the situation is temporary in nature but given some relief to the tenant and saying that they can reschedule their rent with future rent .
