Improperly handled terminations are a major source of headaches for employers. Many organizations do not realize that there is no federal law requirement that you provide a letter of termination of employment. However, there are a number of states that do require for you to provide a service letter to the terminating employee, or in some cases at least provide one if requested. These letters generally need to cover the nature of the employment, the employment dates, and the reason for termination. Regardless of whether or not you provide a letter of termination of employment, you should have all terminations reviewed by an experienced manager above the terminating supervisor. And, in sensitive or involuntary terminations, legal counsel should also be involved.
