America’s criminal justice system contains troubling paradoxes. Americans purportedly enjoy abundant legal protections, such as trial by jury and the right to an attorney. Yet possibly 100,000 innocent defendants have pleaded guilty and are incarcerated, while many others have been convicted under dubious evidence. Even as criminal justice reform is attracting bipartisan interest, our legal system remains deeply dysfunctional.
Judge Jed S. Rakoff of the Southern District of New York makes these and other startling observations in “Why the Innocent Plead Guilty and the Guilty Go Free: And Other Paradoxes of Our Broken Legal System” (Farrar, Straus and Giroux, 2021).
