Condominium Insurance claims are complex and confusing for both unit owners and Associations. The Florida Condominium Act was created to help try to make it clear what the Association is responsible for and what the unit owner is responsible for.
If there is an "insurable event" the Association is responsible for the drywall. The Florida condominium acts puts the responsibility on the Association for the drywall and the unit owner for the "coverings".
What's considered wall "coverings" ?
-Tile
-Paint
-Wallpaper
Don't let the Association try to tell you any different. The legal case law in Florida is very strong on the behalf of unit owners who have sued their Associations in the past. Unit Owners are usually in a very strong position and with the right circumstances, win their case easily.
