Aggravated assault is primarily based upon the level of injury or whether or not a weapon was used, and let me break that down for you. There is what's called "great bodily harm," and that's typically something where you've left a permanent injury to someone that will never heal up. That's at the highest level – first degree level. Then there's second degree assault – aggravated assault. That means that you used some type of weapon. Now, we would think that's a knife or a gun. It could be anything that could cause – any object – that could cause substantial bodily injury, and you used that, or you threatened to use that, against someone.
