What follows the privacy shield? The European Court of Justice declared today that the “privacy shield” is not valid. The privacy shield was used as a workaround between the United States and the European Union. The privacy shield violates European citizens' individual laws as they came to the conclusion that the United States does not protect the privacy of its citizens. Therefore, European companies cannot transfer data to the United States under the privacy shield.
The privacy shield was considered to be a workaround in light of the GDPR, the European general data protection regulation. The idea was also to find an alternative to the safe harbor which is a story from the good old past. Now with the privacy shield gone, the question for you as a business would be: how do I take care of my business when I have a legitimate need to transfer data? The only advice at this time that I have is for you to review the GDPR guidelines, review your practices, and if needed, adjust to that or cut down on data transfer between Europe and America. This may be difficult but you should abide by this in order to stay safe because once you’re subject to GDPR fines, they could be significant.
