As we reflect into the new year, it is still unclear as to when the extension of the public sector IR35 legislation changes into the private sector will into play. Although only a footnote in the budget it has been confirmed that it will be extended to the private sector following consultation.

These legislation changes mean that the responsibility for determining whether or not an off-payroll worker falls in or out of IR35 is now with the hiring organisation, as is any liability for tax/NI contributions.

Private sector businesses who rely heavily on a non-perm workforce can no longer ignore this legislation and must proceed with plans to manage and implement the legislation.
