Right to Life
According to Article 21:
•"Protection of life and personal liberty: No person shall be deprived of his life or personal liberty except in accordance with the procedure established by law."
• This fundamental right is equally available to every individual, citizen and foreigner.
• Article 21 provides two rights:
o Right to life
o Right to personal liberty
• The fundamental right granted by Article 21 is one of the most important rights guaranteed by the Constitution.
• The Supreme Court of India has termed this right as the 'heart of fundamental rights'.
• The authority specifically states that no person shall be deprived of life and liberty without due process of law. This means that this right has been granted only against the state. The state includes not only the government but also government departments, local bodies, Vidhan Sabhas etc.
• Occupying these rights of any individual or any other person is not tantamount to violating Article 21. The remedy for the victim, in this case, will be subject to section 226 or general law.
• The right to life is not just about the right to live. It also involves being able to live a life of dignity and meaning.
• The main purpose of Article 21 is that when the right to life or liberty of a person is taken away by the State, it should be in accordance with the procedure prescribed by law.
