Consumer law is an extension of contract law and therefore requires the essential elements of a contract: offer; acceptance; consideration; and intention to create legal relations.
However consumer law is more specific and deals with contract between a buyer and a seller. The seller is a commercial entity whereas the consumer buys for personal reasons. This creates a power imbalance that lies at the heart of consumer law and is something that the law has to constant tackle.
Consumer law has recently been consolidated in the Consumer Rights Act 2015.
Although consumer law mainly deals with civil law there are also elements of criminal law involved when thinking about corporate manslaughter.
