Hello, in this video we'll be discussing about NGOs and how to choose the right entity for an NGO.
What is an NGO?
An NGO is a non-governmental organization which basically runs not for profit but for the welfare of the public at large. It is said that there is one NGO for every six hundred people in the country.
What are the different types of NGO?
There are three different entities under which you can form and manage your NGO. They are as follows:
Trust
Society
Section 8 company
Which law governs the working of NGOs in India?
There is no specific law which governs NGOs in India, but rather there are rules that each entity must follow. For instance, trusts are governed by the Public Trust Act of each state, societies are governed by the central act that is the Indian Societies Registration Act which has its own state amendments and Section 8 companies are governed by the Companies Act of 2013.
How do you choose the right entity?
There is always a confusion when you intend to start an NGO. The biggest question here is what entity will you choose when forming and running an NGO. The answer depends on what your NGO is and what it aims to accomplish.
For example, if you want to uplift the poor, work on poverty in India, or work on the education system in the country, by providing free education, the right option would be to choose a trust. If you are a group of architects, advocates or doctors who intend to come together and start an NGO, then you must opt for starting a society for running an Ngo. If you intend to raise funds through business and then use that money to help others, you must register as a Section 8 company.
However, it is always advisable to take legal assistance before starting an NGO, as that will help you understand what entity to choose. In case you need any legal assistance in choosing an entity or for registering your NGO, you can reach out to us at www.vakilsearch.com and we will be happy to help you on this. Thank you.
