Judges have gone through interviews to fill seats at the Constitutional Court. But the interview process is expected to start afresh after a legal challenge from the Council for the Advancement of the South African Constitution. The JSC received legal advice that it erred in failing to deliberate on the performance of all the candidates following the interview process in April. The records show that the commission only deliberated on five shortlisted candidates recommended by Chief Justice Mogoeng Mogoeng. And an agreement is expected to be made an order of the court.
