Here are five things to know about misdemeanor traffic offenses in Colorado:

1. There are two types of traffic misdemeanors. Class 1 traffic misdemeanors carry 10 days to 12 months in jail and/or $300 to $1,000 in fines. Class 2 traffic misdemeanors carry 10 to 90 days in jail and/or $150 to $300 in fines. Therefore, misdemeanor traffic offenses carry harsher punishments than traffic infractions, which are just civil violations that carry no possible jail time.
2. Examples of class 1 traffic misdemeanors include careless driving causing a bodily injury, or speeding by 25 miles per hour or more in a construction zone. Examples of class 2 traffic misdemeanors include reckless driving, or careless driving without causing a bodily injury.
3. People who ignore their misdemeanor traffic ticket risk having a bench warrant issued for their arrest. And the DMV may suspend their license until the matter is resolved.
4. People who wish to fight their traffic ticket are entitled to a jury trial of three to six jurors.
5. Convictions for misdemeanor traffic offenses can never be sealed from the defendant’s criminal record. But if the charge gets dismissed, the defendant can petition for a record seal immediately.
