Filing a trademark in the U.S. involves the following steps:
1. Determine Trademark Eligibility
Ensure your trademark is unique and not confusingly similar to an existing trademark.
It can be a word, logo, slogan, design, or a combination of these elements.
2. Conduct a Trademark Search
Search the USPTO's Trademark Electronic Search System (TESS) to check for existing trademarks similar to yours.
This step reduces the risk of rejection due to conflicts.
3. Choose the Right Filing Basis
Use in Commerce: If you're already using the trademark in business.
Intent-to-Use (ITU): If you plan to use it in the future but haven’t started yet.
4. Prepare Your Application
Gather the following:
Applicant’s name and address.
A clear representation of the trademark (e.g., logo or text).
Description of goods/services associated with the trademark.
Date of first use (if applicable).
Specimens showing the trademark in use (for Use in Commerce applications).
Decide the class of goods/services your trademark covers. The USPTO divides products and services into 45 classes.
5. File Your Trademark Application
Submit the application through the USPTO’s Trademark Electronic Application System (TEAS):
TEAS Plus: Lower fee but more stringent requirements ($250/class as of 2024).
TEAS Standard: Higher fee but more flexibility ($350/class as of 2024).
6. Pay the Filing Fee
Fees are per class of goods/services.
7. Monitor Your Application
After submission, the USPTO will review your application.
You may receive an Office Action if corrections or clarifications are needed.
If approved, your trademark is published in the Official Gazette, allowing others to oppose it.
8. Respond to Challenges (if any)
If someone opposes your trademark during the publication period, you may need legal assistance to defend it.
9. Receive Registration
If no opposition arises, the USPTO will register your trademark for Use in Commerce applications.
For ITU applications, you'll need to file a Statement of Use to complete registration.
10. Maintain Your Trademark
File maintenance documents and renewal fees periodically:
Between the 5th and 6th years after registration (Section 8 Declaration).
Every 10 years for renewal (Sections 8 and 9).
