Hospitals have a financial interest in promoting minimally invasive surgery that oftentimes uses medical devices. Well, obviously the medical device company only makes money when their devices are used in a particular procedure.
So medical device litigation centers around the FDA, how the device was approved for use, how the device was marketed to the hospital, how the hospital marketed it. Uh, one of the biggest markers as to whether a device is truly defective is that there will be product recalls, just like there is in the automotive industry when there's a problem with a car.
The beauty of it is it's replicable, meaning that if a device injures a patient in New Jersey, it's going to injure a patient in Alabama the same way. But was it really the product that killed him?
