Mable Wallace sued Indianapolis Public Schools (IPS) and Harriet Rosen, a teacher, for battery. The court refused to use the battery instruction and instead gave the instruction on the defense of incurred risk, which Wallace objected to. The jury found in favor of IPS and Rosen, and Wallace appealed. The court determines whether the jury instructions were correct and whether Wallace's appeal is unmerited.
