This Part focuses on "The Power to Summon/The Power of Summon" or simply "Summons."
President Goodluck Jonathan, Chief Justice of Nigeria Walter Samuel Nkanu Onnoghen, Senate President Dr. Bukola Saraki, Inspector General of Police Ibrahim Idris. What do these names have in common?
SUMMONS!
All of them received court summons while in office!!
While in office in 2013 to be exact, a judge of the High Court of the FCT U. Musale ordered the then President Goodluck Jonathan to appear before it as a witness (that is a witness summons).
Was that a legitimate exercise of judicial authority?
While in office in 2019, the Code of Conduct Tribunal issued a criminal summons against the then Chief Justice of Nigeria Walter Onnoghen.
Is it mandatory that a summons must be personally received by the person therein named?
While in office in 2018, a Grade 1 Area Court seating at Aco Estate, Lugbe, Abuja issued a criminal summons ordering the then-Senate President Dr. Bukola Saraki to appear before it. The same court also issued a witness summons on the then Inspector General of Police Ibrahim Idris to explain Dr. Bukola Saraki's absence from the court.
What is the distinction between a criminal summons and a witness summons?
If personal service on the accused is impossible, how otherwise might service be effected?
Are there consequences for an accused who evades personal service of summons?
What is the correlation between the grant of leave and the service of a criminal summons through substituted means?
