At 12:01 AM on October 1, 2020, Governor DeSantis allowed the expiration of the Executive Order stopping evictions and foreclosures in Florida. Basically, that means that evictions and foreclosures in Florida can proceed through completion - through "Final Action."
Or can they?
While Florida has lifted its moratorium (established by Executive Order), the Centers for Disease Control (CDC) has a ban on evictions related to COVID, and the CARES Act has a ban on foreclosures of federally-backed loans (Freddie, Fannie, FHA, VA, HUD, etc.).
Keep in mind, NONE of these measures forgives or lifts the responsibility to make payments.
While I was surprised that Florida is allowing evictions and foreclosures to proceed, keep in mind, the logic behind the Governor's allowing the expiration of the Executive Order(s) is that the Federal Government (through the CDC and CARES Act) is already preventing evictions and foreclosures.
