Canada's Patent Act and Patent Rules underwent significant reforms in 2019. Here's what you should know about the new patent filing requirements, maintenance fees, deadlines, and reinstating abandoned patent applications.
In this video, intellectual property lawyer Erika Murray discusses the recent changes to Canadian patent laws with PCK's president and co-founder, Stephen Perry. In this video you will learn:
▶︎ Patents can now be filed in Canada by reference to a patent application in another country
▶︎ You can now claim a filing date within 14 months under convention priority
▶︎ The 42-month period for National Phase Entry is reduced to 30 months, unless you can show "due care"
▶︎ Maintenance fees no longer need to be paid by the patent agent or applicant
▶︎ After abandonment due to missed maintenance fees, you must show "due care"
▶︎ A new College of Patent Agents and Trademark Agents will be formed
