The court is considering three motions in a case involving a lost investment transaction. The plaintiffs want to amend the complaint by adding three members of the partnership who reside in South Carolina and removing a non-diverse party. The court notes that individual partners can be sued without other partners, and dropping non-diverse partners would cure the defect in the pleadings. However, the court is not convinced that subject matter jurisdiction over the South Carolina partners of PW-US would be appropriate. The court must also decide on PW-Bahamas' motion to dismiss for lack of personal jurisdiction, and PW-US's motion to dismiss for failure to state a claim.
