Hayley Collins, child custody attorney, explains the process of a child custody temporary hearing.
In a contested custody case, there will very likely be one or more temporary hearings, but not a final trial. Therefore, the outcome of a temporary hearing is very important to the outcome of the case. The judge will order an allocation of parental rights to determine which parent has the right to make decisions about the children. The judge will also make orders for possession of the children. This determines where the kids are going to be when and when each parent will have the children. The court will also make orders for child support and address any concerns for special needs children.
When people are facing a contested custody case, temporary orders hearings can be especially scary because it ultimately is the judge making a final decision about the details of your children. It's very important that you work with your attorney to make sure you're prepared for a temporary hearing so that you can achieve outcomes that are in the best interest of your children.
