So in a partition action, the court must first determine if the property can be split. For example, if it's a vacant piece of land and there are two owners, the court will determine if it can actually split the property down the middle, and each owner get an equitable share, or an equal value in the parcels. Other examples may include structures on the property, but the basic rule is if the court can divide the property equally among the owners, then it will.
