"In clause number 880205, the state of Texas versus Andrea Yates, as to special issue number one the jury returns the following verdict: We the jury, because at least ten jurors have a reasonable doubt as to the probability of the defendant Andrea Yates would commit criminal acts of violence that would constitute a continued threat to society determine that the answer to special issue number one is no, signed foreman of the jury. In clause number 883590 the jury answers special issue number one in the following manner. We the jury, because at least ten jurors have a reasonable doubt as to the probability that the defendant Andrea Yates would commit criminal acts of violence that would constitute a continued threat to society determine that the answer to this special issue is no, signed foreman of the jury and as to each verdict the jury certifies that we the jury determine in open court the above answers to the special issues submitted to us and the same as our verdict in this case, and that is to each case. STORYLINE:
A Texas jury spared a woman, who drowned her five children in a bathtub, from death row on Friday.
Instead they sentenced Andrea Yates to life in prison.
She will have to serve at least 40 years before becoming eligible for parole.
The 37-year-old housewife's lawyers smiled as the verdict was read, but there was no apparent reaction from Yates.
Prosecutors told jurors earlier on Friday that there were reasons to send Andrea Yates to death row but said they could accept a life prison term.
Defence lawyers pointed out that Yates was not a danger to society and said she did not have criminal mind.
Rejecting her insanity plea, jurors convicted Yates, 37, of two capital murder charges on Tuesday for killing three of the children last June.
Yates had pleaded innocent by reason of insanity, contending it was severe psychosis from postpartum depression that drove her to kill seven-year-old Noah, five-year-old John and six-month-old Mary.
Charges have not been filed in the deaths of Paul, 3, and Luke, 2.
