Temporary total disability benefits - also called TTD benefits - compensate you for your missed pay at work if you are hurt on the job and cannot return to work. Under a formula set out in Georgia law, the most you can recover is 2/3 of your gross weekly wage, with a maximum of $575 per week. The maximum TTD benefit changes every year, but in 2017 the cap is $575 per week.
You are eligible for TTD benefits if (1) your employer and their insurance company accept your claim (or if a judge orders them to commence payments); and (2) if an authorized doctor has put you on “no work status.” You can also collect TTD benefits if the doctor has put you on light duty but your employer does not have a light duty job for you.
The insurance company will be subject a 15% penalty if they don’t pay you on time, and you are limited to 400 weeks (about 7 ½ years) of TTD, unless your case is deemed catastrophic.
As you can see, there are a lot of moving parts here and many places where the insurance company can try to avoid paying you, even when you are clearly eligible.
If you have questions about your TTD benefits, please contact me - I’m happy to explain how these rules apply to you in your claim.
