The defendant, Rowe, and the victim had been riding on horseback. The defendant and Rowe were being pursued by the police. Rowe shot and killed the victim. The defendant did not help in any way, but there was a witness who claimed, contrary to his own story, that he had told the victim to take off his hat and die like a man. He was convicted of aiding and abetting the murder.
