Dr. Gabriella Chan is a scientist, lawyer, lecturer, and entrepreneur. She completed a PhD in molecular diagnostics for infectious diseases and undertook postdoctoral work in hand-held diagnostic devices at the University of Toronto. She then earned a law degree (JD) from Osgoode Hall Law School with a focus in business law and intellectual property and trained at a national Bay Street law firm in Toronto. Before founding Yocto Law, Gabriella served as the VP of Legal Affairs at a Toronto-area biotechnology company. Gabriella now advises researchers, start-up ventures, established companies, and stakeholders in the life sciences and health technology sectors.
In addition to her legal practice, Gabriella is Adjunct Professor in the Department of Laboratory Medicine and Pathobiology and Course Director in the Translational Research Program at the University of Toronto where she teaches Intellectual Property and commercialization. Lastly, Gabriella is a mentor at the Health Innovation Hub, and the former lead of Startup Toronto.
Abstract: The first portion of the session will introduce the origins and policy behind patent law, explore the difference between inventors and authors, and examine the elements of patentability, with a specific focus on recent Supreme Court cases on patentable subject matter. The second portion of the session will address patent systems, patent filing strategy, patent timelines, costs, freedom to operate analysis, and patent monetization. In the last portion of the session we will undertake a guided exploration of an issued patent for an assistive medical device commercialized by a Toronto company that improves function for individuals with paralysis due to stroke or spinal cord injury.
