If you’ve been seriously injured or living with a disability, you may be seeking what’s known as long term disability insurance. Unfortunately, getting the benefits you deserve is a complex process filled with obstacles, and one mistake could derail your entire claim.
Attorney Marc Whitehead is based in Houston and handles long term disability cases all over the country. He says that while it is possible to complete the initial application yourself without an attorney’s help, he urges contacting a lawyer if that first application is denied. He says:
“If you receive a denial letter, it is an absolute trap that the insurance company is more than happy to let you fall into: to represent yourself, to do your own administrative appeal. There are some tricks to doing it right and some traps if you don’t do it right that can be fatal to your case.”
He says that many claims are denied because the insurance company doesn’t understand the full scope of your former job. He says:
“You may be classified as a certain type of employee, but when they look at what you actually do, that may not match the job description. And frequently people are denied on that basis, when the insurance company doesn’t understand the physical and mental requirements of the job, usually because of faulty job descriptions.”
In cases like these, attorney Whitehead says it is essential to have a lawyer on your side who can prove the full scope of your disability, the tasks you used to perform, and the medical reasons why you can no longer perform those tasks.
If you have a disability, are having trouble getting the disability benefits you are due, don’t go it alone. Choose a lawyer that lawyers choose at AskTheLawyers.com™.
