Class v. United States | 138 S. Ct. 798 (2018)
Most criminal defendants assume that if they’re convicted of a crime, they’ll have the right to appeal that conviction. But sometimes defendants are limited in what issues they may raise on appeal. The Supreme Court considered this issue in Class versus United States.
After firearms were found inside his locked jeep, a federal grand jury indicted Rodney Class for possession of firearms inside a vehicle parked on the United States Capitol grounds. Class moved to dismiss, claiming he was charged under a statute that violated his right to bear arms under the Second Amendment. After the district court denied his motion, Class entered a guilty plea under an agreement waiving his right to raise certain claims on appeal and preserving others. The agreement didn’t address Class’s right to appeal on the basis that the statute was unconstitutional. Class appealed to the District of Columbia Circuit, arguing that he was convicted under a statute that violated the Second Amendment. The court ruled that the statute violated the Second Amendment and that a lack of notice that firearms weren’t permitted in the parking lot violated his right to due process. However, the court also held that Class’s plea agreement waived his right to raise constitutional claims on direct appeal. The Supreme Court granted cert.
