In a commercial real estate transaction, the broker plays a critical role in evaluating market pricing, purchaser/tenant needs, leverage for negotiation and geography considerations. If there are specific concerns, it is the duty of the client to raise them with the lawyer or broker depending on which party is responsible. I experience client frustration when a lawyer is asked to do a broker's job or a broker is asked to do the legal work.

Many sophisticated clients can forgo a commercial broker if they understand the market, are firm in their pricing, and generally are confident in being able to negotiate in an unemotional manner.
