If you need to file for bankruptcy but your spouse does not, you can file your case individually. However, as I discuss in this video, your non-filing spouse’s income and expenses must be revealed in your petition.
Unless you can document that your income and expenses are totally separate from those of your non-filing spouse, the bankruptcy law assumes that you derive some benefit from your household income, which includes income from your spouse.
There are exceptions to this general rule and we can deduct your spouse’s separate expenses from consideration. You can probably sense that bankruptcy disclosure rules are complex and you should seek experienced bankruptcy counsel for any legal questions.
