Come’on in I’m Michael DelSignore a Massachusetts OUI lawyer, I’m gonna explain the different implications of what happens when you’re facing a second OUI. Main issue when you have a second offense OUI is when did your first offense occur? If it’s within 10 years you face basically a pure second offense where you’re looking at it a 2 year license, the requirement you’ll have to get an interlock device and also you have to do a 14-day Inpatient Program when you have a second offense within 10 years that's the minimum penalty. If the two offenses are outside the 10 years, you’re eligible for what it’s called a Cahill disposition or Cahill plea where you can possibly get a first offense resolution of your case. Where you have to do a 24D Alcohol Education Program, you’ll have a 45 to 90 day license loss but you’ll have to get the ignition interlock device. If you receive with this kind of resolution of your case, sometimes called a Cahill in Court, you won't have to do the 14-day Inpatient Program and you won’t have the 2 year license loss. So depending on when your OUI offense happened, it could make a significant difference in the potential penalty you’ll face when get charged for a second offense OUI.
