What is Breached Standard of Care?

Jeff Portnoy discusses what constitutes a valid medical malpractice suit and the preliminary process of going through the MICP "Medical Inquiry & Conciliation Procedure" with the DCCA "Dept of Commerce & Consumer Affairs" office.

Claims are required to go through the MICP process where they are mediated in an attempt to resolve the dispute. The MICP makes no findings of either standard of care or damages.
