State v. Porter | 698 A.2d 739 (1997)

In nineteen twenty three, the District of Columbia Circuit decided Frye versus United States , establishing the admissibility standard for scientific evidence in most federal and state courts for the next seventy years. Frye held that a primitive precursor to the modern polygraph was inadmissible because the test wasn’t generally accepted as valid in the scientific community. In State versus Porter, the Connecticut Supreme Court reconsidered admitting polygraph evidence in that state’s courts based on new standards for scientific evidence.

Christian Porter was charged with arson in a fire that destroyed his home. Before trial, Porter hired a polygrapher to assess whether Porter was being truthful when he denied responsibility for the fire. The polygrapher concluded that Porter was telling the truth.

The trial court denied Porter’s motion to admit the polygraph results and Porter’s request for a hearing to establish the test’s reliability based on Connecticut precedent prohibiting polygraph evidence. The jury convicted Porter. The Connecticut Appellate Court affirmed. Porter appealed to the Connecticut Supreme Court.
