A South Dakota Marital Settlement Agreement is a divorce instrument used by two spouses filing for an uncontested divorce. Both of whom are looking to settle matters regarding the marriage’s immediate dissolution and life after the divorce. Settlements can often slash time in court and, in some instances, may avoid the need to hire an expensive divorce attorney.

Note that South Dakota is one of the 41 states governed by equitable distribution law. As described in further detail in the video, equitable distribution is the “fair” dispersion of assets. This type of dispersion is not always equal. Therefore, one spouse may receive more or less depending on the nature of the marriage and subsequent divorce.
Once completed and filed, the agreement becomes a part of the divorce action, but it doesn’t grant a divorce decree. A circuit court judge will have to sign the settlement and all other documentation (see “Divorce Forms” below) into effect through a Judgement and Divorce Decree.
