MODIFICATION OF CHILD CUSTODY ORDER
When both parents agree on how they want to alter a child custody order in Nevada, they can simply file a joint stipulation with the court. But when only one parent wants to change the child custody order, then that parent would file a court motion asking the judge to make the final decision. Here are three things to know about modifying child custody orders in Nevada.
1) When a parent with joint physical custody asks to become the primary custodian, the court will grant the request if it finds it would be in the child’s best interest. Courts are more likely to grant primary custody to a parent if the other parent is spending less than 40% of the time with the child.
2) When a parent who has only visitation rights asks the court to grant them joint or primary physical custody, the court will consider not only the child’s best interests: It will also consider whether there has been a substantial change in circumstances affecting the child’s welfare that justifies the modification. Examples are if the primary parent developed a drug addiction or has become abusive.
3) When a parent wishes to move away with a child against the other parent’s wishes, the court will consider several factors, including whether the non-relocating parent would be able to maintain an adequate visitation schedule with the child. Ultimately, the judge will sign off on the move if it finds that it is in the child’s – not the parents’ – best interest.
