No-fault eviction in accordance with the LA Rent Stabilization Ordinance (LARSO).
No-fault eviction that applies when there are no local eviction restrictions in effect.
To determine which category applies to your residential rental property, you must first ascertain whether it falls under the scope of the JCO, the LARSO, or neither.
No fault evictions (JCO)
The recently implemented JCO has extended rent control regulations to residential properties in Los Angeles that were previously exempt, such as single-family homes. Under the JCO, there are specific permissible grounds for a no-fault eviction in the city. If the reason for the no-fault eviction in Los Angeles does not fall into one of the following categories, it will not be considered valid. The permissible no-fault reasons for eviction in Los Angeles according to the JCO are as follows:
Owner or family member move in
Demolish or substantial renovation
Withdraw the rental property from the market
Government order
Convert to affordable housing accommodations
Convert to non residential use
Government owns the property and gets sold
No fault evictions (LARSO)
LARSO has traditionally governed rent control and tenant protections in the city of LA. The following are the most prevalent reasons for no-fault evictions in Los Angeles under LARSO:
Owner or family member move in
Primary renovation work
Demolish or permanently remove rental from the market
Government order
Government owns the property and gets sold
Residential hotel
Affordable housing conversion
No fault evictions - no local restrictions
In the city of LA, landlords who are not bound by any local eviction restrictions have the option to provide their tenants with a 30/60 day notice to terminate the tenancy without needing to meet the criteria for allowable eviction reasons. However, it's important to note that only a limited number of exemptions exist within the just cause tenant protections framework in LA. As a result, the majority of residential properties in the city are unlikely to fall into this category.
