Today, I'm excited to share some groundbreaking news about the recently published digital nomad law, which was officially enacted on April 4, 2024. This new legislation has been long-awaited, taking nearly two years of negotiation and balancing between various ministries. Now, we finally have clarity on this significant development.

The digital nomad visa is a new category designed to complement existing visas. It's important to distinguish this from the freelancer visa, which is aimed at self-employed individuals. The digital nomad visa specifically caters to those who work remotely using technological tools, such as IT professionals, software engineers, and other digital-based occupations. This visa allows remote workers to stay in Italy for more than 90 days, offering a unique opportunity to live and work in this beautiful country.

Key Criteria for the Digital Nomad Visa:

• Non-European Citizenship: Only non-EU citizens are eligible. EU citizens, such as those from Romania or Poland, can freely move to Italy and obtain residency without this visa.

• High-Qualified Worker: The visa targets high-qualified professionals. Jobs that require a diploma, degree, or professional certification in fields like computer engineering, software development, finance, etc., are ideal. Physical jobs or non-remote occupations do not qualify.

• Remote Work for Non-Italian Company: Applicants must work remotely for a company based outside of Italy. Offers from Italian companies fall under different visa categories, such as the blue card for high-qualified workers.

• No Nula Osta Requirement: Unlike other visas, this one doesn't require a Nula Osta from the Chamber of Commerce. This simplifies the process, as you don't need a proxy or wait for additional authorizations.

• Application Process: Applications must be submitted directly to the Italian consulate in your current country of residence. If you're an American living in South Africa, for instance, you can apply through the Italian consulate there.

• Salary Requirement: Applicants must prove an annual income of at least €28,000. This ensures financial stability and aligns with Italy's interest in attracting affluent professionals who will contribute to the economy through taxes.

• Sanitary Insurance: Adequate health insurance is mandatory. This can be easily purchased online or through various insurance providers in Italy.

• Lodging Proof: You must show proof of accommodation in Italy. This can be through a rental agreement, hospitality from a friend, or even a property purchase.

• Work Experience: At least six months of prior experience in your field is required. This can be demonstrated through job contracts, bank statements showing salary deposits, or other documentation.

• Employer Recommendation: A recommendation or reference letter from your current employer is necessary. Specific formats for this requirement might be provided by the ministry in the future.
