Special Counsel Jack Smith slammed a decision by Judge Eileen Cannon to incorporate the Presidential Records Act into a request for jury instructions in Donald Trump’s classified documents case.
The ruling would allow the former president’s legal team to advise the jury that Trump had the ability to designate the items in question under the PRA. Smith’s filing Tuesday night said the jury should be considering facts and not legal issues.
“The Presidential Record Act’s distinction between personal and presidential records has no bearing on whether a former President's possession of documents containing national defense information is authorized under the Espionage Act and the PRA should play no role in the jury instructions.” - Special Counsel Jack Smith
